Abstract: A Practical Overview of Regulations Governing Oil Spills from Oil and Gas Producing Facilities in Texas

Relevant legislation and regulations contained in and resulting from the Clean Water Act; the Oil Pollution Act of 1990; the Texas Oil Spill Prevention and Response Act; national, regional, area, and state spill contingency plans; and Texas Railroad Commission regulations are briefly reviewed. This legislation and regulations are summarized in a checklist of seven essential requirements for operators to follow in order to comply with all applicable federal regulations and state regulations specific to Texas. These essential requirements are listed, as follows: 1) Do not spill oil into or on navigable waters or on land. 2) Immediately report all spills resulting in a sheen of oil on navigable waters and over 5 barrels of oil on land to the proper governmental agencies. 3) In cleaning up and mitigating spills, follow your response plan and cooperate fully with federal and state agencies. 4) Obtain insurance or other proof of financial responsibility in compliance with the provisions of Oil Pollution Act of 1990. 5) Develop and implement a Spill Prevention Control and Countermeasures plan and, if necessary, have the plan approved by the federal government. 6) Develop and implement a response plan(s) that will satisfy requirements of the Clean Water Act, Oil Pollution Act of 1990, and Texas Oil Spill Prevention and Response Act and have plan(s) approved by the federal and/or state government. 7) Obtain an Oil Spill Prevention and Response Certificate from the Texas General Land Office.
