Environmental Regulatory Dilemma of Oil and Gas Industry

David M. Flannery

The oil and gas exploration, development, and production industry presently finds itself confronted with the threat of the imposition of uniform national environmental regulatory requirements. Until now, the industry has been regulated largely pursuant to state regulatory programs that have been specially tailored to the environmental objectives and the geologic and climatologic characteristics of each state. Over the next several years, the public policy underlying the regulation of the industry for environmental protection will be under close review by Congress, state and federal regulatory agencies, private citizens, and the industry.
